Chinese Court Rules in ETS's Favor on Beijing New Oriental School Lawsuit.

In a landmark judgment, the Beijing First Intermediate People's Court An intermediate people's court (中级人民法院) is the second lowest local people's court in the People's Republic of China. According to the Organic Law of the People's Courts of the People's Republic of China  ruled that Beijing New Oriental School ("BNOS") violated copyrights and trademarks for ETS's TOEFL TOEFL

(R). The rulings come after over two and one-half years of litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

The Court ruled that BNOS reproduced and sold GRE, TOEFL, and GMAT test questions in violation of applicable copyright law, and violated the trademark rights of ETS and GMAC GMAC General Motors Acceptance Corporation

. The Court ordered BNOS to stop infringing ETS's and GMAC's copyrights and submit to the Court all infringing materials and printing plates for destruction. It further ordered BNOS to apologize and pay damages, as well as certain litigation expenses and fees.

The favorable ruling clearly demonstrates that China is more committed than ever to enforcing intellectual property rights, and we look forward to many more years of serving Chinese test taker's needs."
