Challenge to GMC over boy's death.


A CHARITY yesterday won its bid to challenge the General Medical Council's decision not to investigate the death of a 10-year-old boy.

Robbie Powell died nearly 19 years ago after doctors failed to detect he had Addison's disease.

He was told in May 2008 this was not possible as the events took place more than five years before the allegations.

Action against Medical Accidents, which offered to help take the case to London's High Court to seek permission to bring a judicial review of the GMC's decision.

Its counsel, Nigel Pleming QC, told Mr Justice Davis it was irrational for the GMC to apply the five-year rule.
