The suit concerned the obligation for UPC to carry the digital version of the Dutch CANAL+ premium channel, currently available only in analog format on the cable network. OPTA ruled in July that UPC has to submit a carriage fee proposal to CANAL+ Netherlands for the digital transmission of the premium channel on its network. OPTA also decided to audit the cable operator's accounts to determine the amount that could be set for signal distribution of the CANAL+ programs, both in analog and digital formats. It is expected that OPTA's audit will be concluded in the next few weeks. CANAL+ Netherlands has close to 280,000 subscriptions to its premium channel, of which more than 30,000 receive the service in digital via satellite. OPTA's decision, confirmed by the Dutch court on Sept. 14, will help make the Dutch premium channel more widely available in digital format on Dutch cable networks.
