), the San Jose, Calif.-based power company today announced it has acquired Montis Niger Inc., a natural gas production company, from Radnor Power, a wholly-owned subsidiary of LFC LFC Liverpool Football Club

Calpine acquired the stock of Montis Niger and certain gas reserves for approximately $7.1 million. Montis Niger owns an estimated 10 bcf of proven natural gas reserves and an 80 mile pipeline system which ties into the company's Greenleaf 1 and 2 gas- fired power plants near Yuba City, Calif. Located in one of the largest gas producing basins in California, the pipeline is capable of transporting up to 50 million cubic feet per day of natural gas.

The Montis Niger acquisition will significantly lower the company's fuel costs for its Greenleaf facilities. Since fuel costs are the largest operating expense of a gas-fired power plant, these cost savings will provide the company with a competitive edge in providing low-cost electricity to the deregulated power market.

Montis Niger operates gas producing properties on leases located in Sutter, Yolo and Colusa counties in Northern California. Plans to expand Montis company, serving customers in the United States and selected international markets. At a press conference to be held at 11 a.m. this morning at the State Capitol, the Sacramento-based Pacific Legal Foundation will announce its legal action in the Los Angeles Federal District Court intended to release Proposition 187 from judicial limbo.

The press conference is being sponsored by California State Senators Richard Mountjoy, Ray Haynes, and Ross Johnson. Enacted Nov. 8, 1994, Proposition 187 removes a major incentive for illegal immigration by denying state-funded welfare, education, and nonemergency health care benefits to illegal immigrants.

Federal District Court Judge Mariana Pfaelzer struck down as unconstitutional major portions of the measure on Nov. 20, 1995. But rather than issuing a final, appealable order, the court has maintained control over the fate of Proposition 187 by ordering state officials to draft implementing regulations for certain provisions.

PLF's lawsuit is being filed on behalf of the Alan C. Nelson Foundation of Americans for Responsible Immigration immigration, entrance of a person (an alien) into a new country for the purpose of establishing permanent residence. Motives for immigration, like those for migration generally, are often economic, although religious or political factors may be very important. , the coauthors, sponsors, and supporters of Proposition 187. Its officers include Senator Mountjoy, Hal Ezell, Bill King, and Pete Nunez. PLF's action is expected to move the case forward with the expectation of obtaining review from the federal Ninth Circuit Court of Appeals, and ultimately from the U.S. Supreme Court.

In November 1995, Judge Pfaelzer struck down the portions of Proposition 187 that require, 1) the exclusion of illegal immigrants from public elementary and secondary schools, and 2) local law enforcement and the state Attorney General's cooperation with the Immigration and Naturalization Service Noun 1. As to the initiative's provisions excluding illegal immigrants from publicly funded health care services, the District Court ordered the state to submit proposed regulations "applying" Proposition 187, and proposed rules for the state's prenatal care and long-term care programs were filed under seal. The court received those secret regulations last year but has yet to take action. "After two years, the people are entitled to a resolution of this important case. Justice delayed is justice denied "Justice delayed is justice denied" is a legal cliché meaning that if legal redress is available for a party that has suffered some injury, but is not forthcoming in a timely fashion, it is effectively the same as having no redress at all. ," said Corry.
