Calling the hogs.Two auto shops are ready to rumble in the name of the Razorbacks. Razorback Muffler Inc. of Farmington in Washington County said it has been using its name and logo of a running hog since 1980. But then Razorback Muffler officials noticed Razorback Exhaust LLC of Sherwood, which also uses a hog as a mascot. Razorback Muffler officials asked Razorback Exhaust to stop using the name and logo, but Razorback Exhaust owner Jason Fields continued, according to the lawsuit Razorback Muffler filed April 11 in Pulaski County Circuit Court. Razorback Muffler now wants an undisclosed amount of cash for what it says is trademark infringement. Fields said he changed the name of his business about a month and a half ago to Arkansas Performance Exhaust. (But its Web site is still Razorback Exhaust, and Fields still uses the Razorback as a mascot.) Fields said that the two businesses are completely different. His deals mainly with improving the vehicle's performance while Razorback Muffler repairs the mufflers, he said. And the hog mascots are even running in different directions, Fields said. "I'm not giving him anything," Field said. "I don't want to fight with anybody.... I didn't even know there was a Razorback Muffler in the state." Several companies have shed the Razorback name over the years, and it may not have had anything to do with the Hogs less-than-stellar performance. The University of Arkansas decided to trademark the name and its several logos. Now, if a business using the Razorbacks name opens, a licensing fee heads straight to Fayetteville. |
