California Department of Corporations announces settlement in Pacificare suit.


LOS ANGELES--(BUSINESS WIRE)--Nov. 1, 1996--

Department granted access to peer review

and medical records

The California Department of Corporations on Friday announced that it has agreed to a settlement with Pacificare of California regarding a lawsuit over the department's access to medical records and peer review records.

The settlement arises out of a September 1995 suit filed by Pacificare to block the department from obtaining access to documents necessary for the department to ensure regulatory compliance with California law California Law consists of 29 codes, covering various subject areas, the State Constitution and Statutes. Under the settlement, signed Friday by Judge John M. Watson, Pacificare agrees that "the DOC is entitled en·ti·tle  
tr.v. en·ti·tled, en·ti·tling, en·ti·tles
1. To give a name or title to.

2. To furnish with a right or claim to something:
 to reasonable access to all records and unredacted documents maintained by Pacificare in connection with the operation of the health service plan(s) which it operates and which are licensed and regulated by the Commissioner and the DOC that are necessary to the performance of the DOC's regulatory functions as prescribed pre·scribe

In addition Pacificare also agreed that "the DOC is entitled to request and obtain from Pacificare ... a copy of all the complaining subscriber's or enrollee's medical records or unredacted documents that relate to the allegation The assertion, claim, declaration, or statement of a party to an action, setting out what he or she expects to prove.

If the allegations in a plaintiff's complaint are insufficient to establish that the person's legal rights have been violated, the defendant can make a
