Failure to state a claim is frequently raised as a defense in civil litigation. and the prisoner appealed. The appeals court affirmed in part, and vacated and remanded in part. The appeals court held that the prisoner's allegations stated an Eighth Amendment claim. The prisoner alleged that he was strip searched in front of female officers, that the officers made explicit gestures during the search and forced him to perform sexually provocative acts, and that the female officers were invited spectators. The appeals court also held that the Civil Rights of Institutionalized Persons Act (CRIPA) that barred federal civil actions by prisoners for mental or emotional injuries without a showing of physical injury, did not foreclose fore·close v. fore·closed, fore·clos·ing, fore·clos·es v.tr. 1. a.
