Cable advisory officials resisted adopting a policy manual for more than a year.

Town Manager Theodore D. Kozak sent town counsel William Hewig III a draft copy of a local cable access policy manual dated Aug. 22, 2007, to review after the recent controversy. Mr. Hewig recommended Friday that the town establish the community standards review board.

Mr. Hewig told selectmen last night that in crafting the proposal for the review board, he recognized the solution must balance freedom of speech and that obscenity is not protected speech. Mr. Hewig proposed that the new board consist of three members. Those members, according to according to

If the programming is deemed to have indecent material, the program will only be allowed to air between midnight and 4 a.m.

Mr. Hewig said, however, that the new board would have to operate with strict procedures and guidelines, and the proceedings could be adversarial. A citizen who submits a tape for broadcast that the board finds objectionable would have the right to be represented by a lawyer.

Mr. Hewig said the new board's actions might be considered censorship by some people.

Many variations and alternatives are possible, and Mr. Hewig said this proposal is only intended to serve as a framework. "This is very much a work in progress," Mr. Hewig said. "The only advice I could give to you: It must be fair."

The board asked a few questions, including what other communities have adopted similar standards review boards.

"I have not seen one," Mr. Hewig said. He told selectmen he has handled local cable access issues in between 50 and 70 towns in Massachusetts This is a complete list of towns in Massachusetts, arranged in alphabetical order.
