CVS Selling Expired Infant Formula, Baby Food, Other Medicines and Products According to Change to Win.

Expired Products

Surveyors purchased 21 packages of expired goods, including over-the-counter medicines, infant formula, baby food and milk products at 14 CVS stores around Orange County over the last few weeks. Most of the expired products purchased are for infants and children, including Infant gas-relief drops that had expired more than 10 months before purchase, bought in a Cypress CVS; infant formula that was six months out of date, bought in a Laguna Beach Laguna Beach (ləg`nə), city (1990 pop. 23,170), Orange co., S Calif., on the Pacific coast; founded 1887, inc. 1927.  CVS; baby food bought in a Lake Forest CVS that had expired five months before purchase; and children's motion-sickness medicine purchased in a Santa Ana CVS four months after the sell-by date.

"How can CVS expect mothers to trust them when they seem to be unwilling or unable to stop selling expired products and medicine that can hurt our children?" said Dr. Kim Salter, representing National Organization for Women (NOW) of Orange County. Dr. Salter led a delegation into the CVS drugstore to speak with the manager about the expired products purchased at local CVS stores.

Last June, Attorney General Brown criticized CVS for selling expired products at dozens of stores in Southern California. The Attorney General said the practice violated laws against deceptive advertising and unfair business practices.

"CVS is insulting our families and communities, taking money for products that they should have pulled from their shelves and endangering our kids," said former Santa Ana city councilman Mike Garcia who participated in the demonstration with his family. "They've got to stop."

HEALTH CODE VIOLATIONS

CVS sales of expired products raise additional concerns in Orange County because of CVS' record of health violations. A review of Orange County Health Care Agency inspections found that CVS stores often lack clean and adequate hand-washing facilities for employees, frequently have dirty or malfunctioning refrigeration refrigeration, process for drawing heat from substances to lower their temperature, often for purposes of preservation. In the last two years, county health inspectors cited 55 CVS stores for code violations related to hand-washing facilities - over 75% of the stores they surveyed. Inspectors found dirty or malfunctioning refrigeration units - including mold, food residues, or unsafe food temperatures in refrigerators - at nearly half the stores they surveyed, 36 out of 73. Over one quarter of Orange County CVS stores (20) have been cited in the last two years for inadequate vermin proofing or for evidence of vermin themselves.
