CSUN'S BEAUREGARD AWAITS HIS RETRIAL.Byline: Daily News The retrial retrial n. a new trial granted upon the motion of the losing party, based on obvious error, bias or newly-discovered evidence. (See: newly-discovered evidence) of former Cal State Northridge football player Jonathan Beauregard, who is charged with two counts of attempted murder, did not get under way as expected Wednesday. Beauregard, who played for Northridge in 1993 and '94, is charged with shooting his girlfriend, Dunyella Smith, and her friend, Von Thompson, on Aug. 29, 1994. He has pleaded not guilty. His first trial ended last October with the jury deadlocked 10-2 in favor of conviction. Prosecuting attorney Cheryl Kersey told the San Bernardino Sun on Wednesday that Smith would not testify during this trial. Smith originally told police that Beauregard was definitely the shooter. But on the witness stand witness stand n. a chair at the end of the judge's bench on the jury box side, usually with a low "modesty screen," where a witness sits and gives testimony after he/she has sworn to tell the truth. When called to testify the witness "takes the stand." Most witness stands are equipped with a microphone linked to an amplifying system so that judge, attorneys and jury can hear the testimony clearly.
