COURT VICTORY; Defiant in face of new ruling.

A TEESSIDE council has won a court battle over a tent protest against a controversial development.

But The Friends of Coatham Common, who oppose the plans, say the court decision is neither a total defeat for them, nor a total victory of the council.

The court action followed a protest by James Willis who put up a tent on the land.

Mr Willis, a former Green Howard, said: "I began my protest after the erection of perimeter fencing which blocked public access."

He claimed the erection of the fencing clearly contravened covenants which stated no structure was to be built and the land was to be kept for recreational purposes. common and the development plans to build on all of this and completely remove it.

Representing Mr Willis in court was campaign spokesman Chris McGlade.

He said: "The judge ruled it a straightforward possession order so the council can remove James's tent for 'occupying their land'. We want to make quite clear the ruling does not stop James from using the land nor does it stop the public."

A spokesman for Redcar and Cleveland Council said: "We will be analysing the judgment in due course."

Persimmon Homes is planning a mixed development of leisure, entertainment, sporting and housing facilities on the site.

Friends of Coatham Common, which opposes the scale of the housing element in the development, successfully brought a court challenge to the planning consent granted last April for the Coatham Development. It is now likely a new planning application will be submitted for the planning process to be re-run.

Mr Willis said there was a conveyance attached to the deeds for his house in High Street West stating he had benefit to the covenants and right to a back lane for access.
