COURT RULES DONNELLY CORPORATION IS INFRINGING GENTEX PATENT FOR ELECTROCHROMIC DEVICES

ZEELAND, Mich., March 17 /PRNewswire/ -- The Federal District Court today ruled that Donnelly Corporation (AMEX: DON) is infringing Gentex Corporation's U.S. Patent No. 4,902,108 ('108 patent) for "Single- Compartment, Self-Erasing, Solution-Phase Electrochromic Devices, Solutions for Use Therein and Uses Thereof."
"This victory represents a major milestone for Gentex Corporation in our ongoing patent litigation against Donnelly Corporation," said Gentex Executive Vice President Kenneth LaGrand. "This Gentex patent is very broad and protects not only our automatic-dimming mirror product line, but also any other type of electrochromic device utilizing this technology, which could include automotive sunroofs and windows, and windows for commercial architectural applications.
"Gentex will seek damages caused by Donnelly's infringement of this patent. We also will contend that any damages awarded should be trebled because Donnelly's infringement has been willful," LaGrand stated.
The Dec. 14-17, 1992, trial of the '108 patent was the second trial in a longstanding dispute between Gentex and Donnelly regarding four Gentex patents.
A two-week jury trial on all liability and damage issues for a fourth Gentex patent (U.S. Patent No. 5,128,799) -- including validity, enforceability, infringement, willful infringement and damages -- is scheduled for March 22, 1993. A trial of the infringement and willful infringement issues of Gentex U.S. Patent No. 4,443,057 for an "Automatic Rearview Mirror for Automotive Vehicles" is scheduled for June 7, 1993.
The Court also ordered that a status conference be held sometime during the March 22, 1993, trial to schedule resolution of the remaining issues including damages with regard to the '108 patent.
Gentex Corporation (NASDAQ: GNTX) develops, manufactures and markets proprietary electro-optical products: patented automatic-dimming Interior and Exterior Night Vision Safety(TM) (NVS(TM)) Mirrors for the worldwide motor vehicle industry, and an extensive line of fire protection products for commercial applications.
