COUPLE TO STAND TRIAL IN CHILD ABUSE CASE.

An Oxnard couple charged with murdering their daughter last year was ordered Wednesday to stand trial on several felony felony (fĕl`ənē), any grave crime, in contrast to a misdemeanor, that is so declared in statute or was so considered in common law.  counts stemming from the alleged abuse of the child two years earlier.

After a 2-1/2-day preliminary hearing, Ventura Superior Court Judge Steve Perren ordered Rogelio Hernandez, 19, tried on one count of torture torture, the intentional infliction of severe physical or mental pain or suffering in order to intimidate, coerce, obtain information or a confession, or punish.  and five counts of child abuse causing great bodily injury.

Gabriela Hernandez, 18, was ordered tried on four counts of felony child abuse. However, Perren ruled there was insufficient evidence insufficient evidence n. a finding (decision) by a trial judge or an appeals court that the prosecution in a criminal case or a plaintiff in a lawsuit has not proved the case because the attorney did not present enough convincing evidence.  to try her on the torture and one of the five abuse charges.

This case pertains to the injuries their daughter, Joselin, suffered in July 1994 when she was 2 months old, and is separate from the murder trial the defendants face in the toddler's death last year.

They were ordered to stand trial on murder and other charges after a preliminary hearing in January.
