COUNTY FAIR BOARD REBUKED CLOSED-DOOR SESSION CALLED INAPPROPRIATE.

The vice president of the Ventura County Fair board faulted the panel Wednesday for not operating more openly in the past and cited an Attorney General's Office warning about open-meeting law improprieties.

At Tuesday's meeting, Gherardi told fellow board members during a discussion about whether to sell the modular home Modular homes are houses that are divided into multiple modules or sections which are manufactured in a remote facility and then delivered to their intended site of use. The modules are assembled into a single residential building using either a crane or trucks.  that the decision by previous officials to buy the home was inappropriate because it had been made in closed session.

``This is not what you take into closed session,'' she said. ``You go into closed session for personnel or litigation An action brought in court to enforce a particular right. The act or process of bringing a lawsuit in and of itself; a judicial contest; any dispute.

When a person begins a civil lawsuit, the person enters into a process called litigation.
 (issues). Buying a modular home is not appropriate.'' Board President Greg Carson said that while the former board had allowed $100,000 to be spent on the home, $140,000 was spent on it.

``This should be upfront. This is not something you go and hide,'' she said.

The board members decided to keep the home because they didn't want to lose the investment in it, she said.

Gherardi said she could not comment on whether the money spent on the home factored into Gibbs' decision to resign in December after being placed on administrative leave. She said she was not legally permitted to discuss personnel issues.

Gibbs' lawyer, Jonathan Light, said he did not know of any open-meeting violations.

But, he said, ``Everything related with that house was done with the approval of the (former) board.''
