COUNTY CONSIDERING FINE FOR LIBRARY CONTRACTOR.

The county may levy a fine of more than $1,000 against the contractor building an expansion to the Moorpark Library for violating state law.

 Construction Co. of Encino violated the state Public Contract Code by illegally substituting plumbing subcontractors on the library project.

But Caspian Plumbing did no work on the library. Instead, Loris Plumbing completed the job, officials said.

``We contacted both subcontractors,'' said Quinn. ``The original one said `We were ready to do the work and we wanted to do it but the prime contractor said he decided to use somebody else.' ''

The state Public Contract Code requires contractors to list subcontractors for different facets of projects and secure consent from the county for any changes.

``There was no effort to hide it,'' said Quinn. ``Whether they honestly didn't think about it or forgot or said `ah hell, it's worth the risk' - we'll never know.''

Representatives from RCO could not be reached for comment Thursday.

Although state law allows the county to fire the contractor for the violation, Quinn said public works officials decided against canceling the contract because RCO had performed well on most other aspects of the job and because the expansion was nearing completion.
