COUNCIL RESISTS MAYOR'S PLAN FOR TOBACCO FUNDS.

She is a former member of the California State Assembly.  said she believed the money should be used on health-related programs, such as providing the seed money for a series of clinics the county wants to open in each council district.

``These clinics could go a long way in helping treat children,'' Goldberg said.

At the same time, concern was raised over possible sanctions by the U.S. Department of Justice against the city for failing to make curb cuts to bring the city in compliance with the American with Disabilities Act.

``If we don't show a serious effort - and we're talking $50 million over the next five years - the (Justice Department) said they will take action,'' said Councilman Mike Feuer.

However, Goldberg argued the city should have been setting aside money for the program before this year.

``I am embarrassed that we might be sued and I'm embarrassed that we need to be threatened,'' Goldberg said. ``But this did not occur overnight. We all knew what the Department of Justice was saying.''

If the city does not use the money for curb cuts, Councilwoman Laura Chick asked if there were any contingency plans A plan involving suitable backups, immediate actions and longer term measures for responding to computer emergencies such as attacks or accidental disasters. Contingency plans are part of business resumption planning. .

,'' Chick said. ``We can't simply say no to (Riordan's) proposal without coming up with another.''

The proposal from Riordan, modified slightly by Feuer, calls for at least $10 million a year to be spent on the curb cuts and sidewalk repairs, with any remaining funds, estimated at $2 million a year, going for youth programs.

Councilman Mike Hernandez said he also wanted information on what various city agencies, such as the Department of Water and Power and Department of Transportation, were doing in making curb cuts as they worked on city streets.
