COUNCIL MULLS DEATH PENALTY DAVIS URGED TO CREATE STATE COMMISSION ON EXECUTION.

The Los Angeles City Council The Los Angeles City Council is the governing body of the City of Los Angeles, California, United States.  delved into a touchy philosophical debate Wednesday over the death penalty, prompting another debate about whether the council meddles in issues that are not its business.

Originally, the council was set to vote on a resolution sponsored by Councilman Eric Garcetti Eric Garcetti (born 1971) is the son of former Los Angeles county district attorney Gil Garcetti, and was elected to the Los Angeles City Council in 2001. He was reelected in 2005.  urging the state to impose a moratorium on executions, but some council members said they were uncomfortable getting involved in state policy.

Councilmen Dennis Zine and Ed Reyes concurred, adding that taking a stand would send a bad message to a city still reeling from a spate of murders in the last week.

Zine said victims of violence in the city, including victims of the recent fatal shootings, deserve justice.

Garcetti argued that the council does have a stake in the death penalty, which he said affects constituents in every council district. He also noted that the council frequently gets involved in non-city matters.

``We make recommendations on things all the time,'' Garcetti said. ``So I think this is properly in our purview The part of a statute or a law that delineates its purpose and scope.

Councilman Nate Holden backed Garcetti, noting that the council has taken stands regarding situations in the Middle East, repression in Asia and apartheid in South Africa.

``This is part of our jurisdiction as well,'' Holden said.

Other municipalities that have no jurisdiction over state executions have already adopted resolutions asking for a state moratorium on capital punishment capital punishment, imposition of a penalty of death by the state. History

Ultimately, the council decided to send the resolution to a council committee for discussion and adopted a substitute motion by Councilwoman Wendy Greuel that urges the governor to set up a commission to examine who gets executed and then make recommendations to ensure the process is fair and just.

That motion was approved by all 10 council members present.
