A judge decides a case "on the merits" when he/she bases the decision on the fundamental issues and considers  of the alternative itself and not on a straw-man proposal,'' Parks said. ``No one in their right mind would take a steep hillside with landslide matter and put a basin in there. That is where they assumed I am proposing and shot it down.''

But Mayor Dan Del Campo and Councilman Dennis Gillette, however, are not convinced that the wrong site was studied.

``From the photographs we were given, the borings were taken in the correct location,'' said Gillette, who has not made up his mind on the proposal.

Del Campo also said he is open to further study.

``I think at this point, there is still a window of opportunity we can review any other alternative, whether it be Parks' or any other feasible engineering construction,'' Mayor Dan Del Campo said. ``I, for one, would like one final answer.''

The U.S. Army Corps of Engineers has issued a permit for the project, and only the state Division of Safety of Dams and the state Fish and Game Department need to give their OK, said Jeff Pratt, deputy director of the Ventura County Public Works public works
