The agreement was hailed as a major step forward.

``This resolves an unfortunate long-standing disagreement over the Warner Center specific plan,'' said Councilwoman Laura Chick chick

The school district had sued the city in 1993 when it adopted its specific plan for Warner Center, contending there was not sufficient study of noise and air pollution on neighborhood schools.

That fund could reach up to $1.3 million, officials said.

``We think this makes everyone happy,'' said Brad Rosenheim, a consultant with the Warner Center Association who was involved in the talks. ``This provides certainty for developers that they can go ahead with their projects without the threat of any other actions, addresses the concern of the school district on potential problems and resolves the issue for the city.''

Rosenheim and the Warner Center Association initiated the discussions about six months ago that led to the settlement.

The first project to be affected by the agreement is work at the Prudential Insurance building. Another project said to be in the works is for an expansion at Topanga Plaza.
