The testimony came in the third day of Randy Valli's trial on one charge of misdemeanor battery for allegedly slapping restaurant co-owner Sandra ``Alex'' Sofsky.

 Frankie Avalon and his wife, Kay, all seemed fairly agreeable the night of Oct. 7 when the group allegedly grew obnoxious and refused to leave the Secret Garden restaurant.

``I served the table all the way, and everything was normal,'' said Ceballos, who was not present when Randy Valli allegedly shouted obscenities and slapped restaurant co-owner Sandra ``Alex'' Sofsky.

Randy Valli, he added, ``was like anybody else.''

Ceballos said Frankie Avalon commented about the waiter's tuxedo and about the menu prices, but nothing came of the remarks.

After serving the soup, salad and entrees, Ceballos said he introduced Frankie Avalon to his boss, Bob Sofsky, and then returned to the kitchen.

However, Bob Sofsky testified that the group became belligerent and offensive and seemed to be intoxicated.

When Avalon complained about the menu prices, Bob Sofsky said he ``tried to joke with him. It didn't work, and then it disintegrated.''

The case is scheduled to continue today with testimony from Frankie Avalon.
