 COMPAQ AND DELL SETTLE LAWSUITS
AUSTIN, Texas, Feb. 10 /PRNewswire/ -- Dell Computer Corporation

(NASDAQ: DELL) and Compaq Computer Corporation (NYSE: CPQ) today announced that they have reached a worldwide settlement of all pending litigation.
Compaq had sued Dell and Dell's advertising agency, Goldberg Moser O'Neill (GMO), over advertisements published in the United States and United Kingdom, claiming that the ads were false and misleading. Dell had filed counterclaims against Compaq and The Ogilvy Group, Compaq's advertising agency. The settlement results in dismissal of all claims by all parties involved in the litigation.
The settlement involves no final adjudication by the courts nor any admission of wrongdoing by any party. However, Dell agreed to the entry of consent decrees in the United States and United Kingdom prohibiting violation of applicable laws in any future Dell advertising that refers to Compaq.
The settlement also includes a cash payment from Dell to Compaq. The parties have agreed not to disclose the amount. However, the settlement will not have a material effect on the financial statements of any of the parties.
As part of the settlement terms, all parties have agreed not to comment further on any aspect of the litigation.
