 COLUMBUS SOUTHERN POWER FILES APPEAL WITH OHIO SUPREME COURT
 COLUMBUS, Ohio, Sept. 1 /PRNewswire/ -- Columbus Southern Power Company filed an appeal with the Ohio Supreme Court today asking the high court to overturn major portions of the Public Utilities Commission of Ohio's (PUCO) opinion and order in the company's 1991 rate increase request.
 On May 12, the PUCO granted the company a $123 million increase -- roughly 60 percent of the company's original request -- to be phased-in over a three-year period, and disallowed $165 million of the company's investment in the Zimmer generating plant.
 "If allowed to stand, the $165 million disallowance will completely erase the company's retained earnings and affect our ability to continue providing our customers with reliable electric service," said Thomas R. McCaffrey, CSP president and chief operating officer.
 In its appeal, the company argues that the PUCO unlawfully modified the 1985 Stipulation and Recommendation that paved the way for the conversion of Zimmer from a nuclear to coal-fired power plant.
 "While the PUCO's recent decision on our request for rehearing provided a modest increase in revenues, the Commission refused to hear arguments on our primary objection -- namely the disallowance of a large portion of our investment in the Zimmer project," McCaffrey said.
 Columbus Southern Power provides electric service to more than 560,000 customers in all or parts of 25 central and southern Ohio counties.
