CLEARED; So why isn't schoolboy going to be prosecuted for forcing teacher to perform oral sex while he filmed it on his mobile?

A MARRIED teacher who gave a pupil of 15 oral sex while he filmed the act on his mobile phone was cleared yesterday.

Mrs Poole has given up the career she loved - but the schoolboy who wrecked her life will NOT be prosecuted.

Last night the decision not to take him to court over what she described as "oral rape" amazed a·maze

A teacher union source said: "This is every teacher's worst nightmare - to be a victim of sexual assault, then to be charged with assault yourself."

It took a jury just 70 minutes to clear Mrs Poole unanimously of three counts of sexual activity with a child and one of abuse of trust.

Her sobs of relief at being cleared rang round the hearing. Tears ran down her face as she mouthed "Thank you, thank you" at the jury. Later clinging to her builder husband Dacey, 26, she said she was "very happy, ecstatic ec·stat·ic

Solicitor Andrea Jones said: "She wants to thank her family and friends for their unwavering loyalty, and particularly her husband for his constant support."

Asked if the boy, now 17, should be charged with rape, she replied: "That's a matter for police."

The prosecution claimed she met the boy for sex sessions in her husband's Porsche.

But a fellow teacher gave Mrs Poole an alibi for every time the pupil said they had sex. And the boy's DNA DNA: see nucleic acid.

The youth alleged she frequently called him late at night for phone sex. But there was no evidence of calls between them.

Mrs Poole, of Hollywood, North Worcs, was arrested when the boy's parents found the phone film of her giving their son oral sex in a drama theatre. The footage was played in court.

Mrs Poole told the jury: "He hit me with the screwdriver. I was the victim. He abused me, full stop. I'll never teach again because of it."

Police said yesterday prosecutors were aware of Mrs Poole's defence before they took her to court. The CPS (1) (Characters Per Second) The measurement of the speed of a serial printer or the speed of a data transfer between hardware devices or over a communications channel. CPS is equivalent to bytes per second.  said she had not formally complained about the incident.

Mrs Poole's solicitor Fiona Warman said the teacher did not want to take the matter further.

She said: "My instructions are not to pursue this. As far as Mrs Poole is concerned, the incident is closed. It is not that it didn't happen, but closure is good."
