CLASS ACTION LAWSUIT FILED AGAINST LENNAR
FOR DAMAGES RESULTING FROM HURRICANE ANDREW
MIAMI, Sept. 10 /PRNewswire/ -- Citing shoddy construction practices and the use of improper materials, a class action lawsuit has been filed in Dade County Circuit Court against Lennar Homes, Inc. by homeowners in three South Dade residential communities developed by the company, for damages resulting from Hurricane Andrew.
The class action suit was filed on behalf of homeowners in the communities of Lakes By the Bay, Edgewater Park and Villages of Deerwood.
According to attorney Louis Robles, "The homeowners feel that the damages to their communities are significantly worse than they should have been, based upon damages to neighboring communities which were built by other developers."
Robles and Ervin Gonzalez, partners in the Miami law firm of Robles & Gonzalez, represent the homeowners in the lawsuit.
If the classes are granted by the court, damages would be sought for all homeowners living in the named communities.
As part of the suit, the homeowners also sought injunctive relief against Lennar, to halt the company's practice of requesting that homeowners agree to allow Lennar to negotiate on their behalf with insurance companies for the purpose of obtaining their insurance proceeds, which would then be used by Lennar to repair or replace their homes.
"Before agreeing to that type of arrangement, the homeowners need to receive the advice of legal counsel," said attorney Gonzalez. "Many of the homeowners are in a vulnerable position right now, and need to consider the consequences of such an agreement."
