The suit filed by attorney Richard Francis Richard Francis (dates unknown) was a famous English cricketer who played for the Hambledon Club.

Francis is known to have been a Surrey man by birth and he had played for Surrey teams before moving to Hampshire. He made 47 known first-class appearances from 1773 until 1793.

Francis said the Moorpark council approved the 3,221-home development without checking whether it is compatible with all of the elements of the city's General Plan.

The area's zoning designation was rendered inconsistent with the open-space and recreational element when the zoning change was approved, he said. The zoning was changed from open space to residential.

Francis said while the land-use element of the General Plan was changed to accommodate the development, the open-space element was not.

In trying to beat the Save Open Space and Agricultural Resources initiatives the Nov. 4 ballot, the council forgot one or more of the elements of the General Plan, Francis said.

State law requires the city adopt a General Plan comprising five elements five elements,

While he said he couldn't comment on Francis' lawsuit, he did say the specific plan adopted for the area by the council in August was consistent with all elements of the General Plan.

``The specific plan adopted with this project addressed consistency with each of the General Plan elements,'' he said. ``It identifies the goals and policies of the elements, discusses consistency with each element of the General Plan, including the open-space and recreation element.''
