Judge Dickran Tevrizan ruled that the city should not be involved in the lawsuit, which was filed in January by Cemex Inc., the parent company of Azusa-based Transit Mixed Concrete. The lawsuit asserts that the Board of Supervisors inappropriately used the environmental review process, which lasted more than a year, as a tool to delay and interfere with the federal government's approval of the plan. After the suit was filed, the supervisors unanimously rejected TMC's application for a surface mining permit, finding that the studies of the traffic generated by the 56.1 million ton mine were inadequate. The suit asks the judge to order that the mine be allowed to move forward without the permit.
