CITY COUNCIL TO DECIDE AIRPORT BUILDING PERMITS ISSUE BURBANK RESIDENTS AWAIT ACTION ON THEIR APPEALS AGAINST PROJECT.

BURBANK - The City Council tonight will consider moving forward with recommendations to issue building permits to Burbank Airport for 45,000 square feet to accommodate new security equipment.

Saying the proposal complies with the Burbank Municipal Code, the city's community development director, Sue Georgino, has recommended issuing the permits for the federally required security project.

 Hyman contend that local law gives voters the right to decide on any agreement between city and airport officials for an expanded terminal.

City officials are working under a contingency contingency n. an event that might not occur.  ordinance A law, statute, or regulation enacted by a Municipal Corporation.

, but cannot change the provisions of the Burbank Municipal Code.

``The city (officials are) saying that under the ordinance they have no discretion in approving the final permits,'' Rothenbach said. ``But that's not so.''

Burbank Airport Authority officials plan to use the 45,000 square feet for federally ordered security improvements, including adding more baggage-screening equipment.

Construction began last month before Measure A was overturned. But because permits had not been approved by the city's community development director, city officials halted the work.

Action on the permits must wait until after the council decides the appeals from Rothenbach and Hyman.

``Assuming we get a decision, the permits may be issued by the end of this week,'' Georgino said.

The Burbank Airport Authority board remains uncertain on when construction will resume and on whether a federal deadline of Dec. 31 will be met, spokesman Victor Gill gill, in weights and measures

``We are absolutely outside of the envelope in terms of the deadline,'' Gill said.
