Based on the submissions, the Tribunal concluded that Calian met the mandatory criteria of the Request For Proposal, and declined to award any remedy to Med-Emerg.The Tribunal further concluded that Med-Emerg would not have been awarded the contract in any event, as it could not overcome Calian's price-per-point advantage.

'We are very pleased with the Tribunal's decision today and intend to continue to focus our efforts on the civil action brought against the Company with respect to this contract and to vigorously defend the claim, including the basis of the claim and the amounts being sought. Management believes that it will be successful in its defence of the claim advanced against the Company," stated Ray Basler, Chief Executive Officer of Calian.
