CHURCH RETURNS TO COURT : OVERTURNING SOUGHT ON CATHEDRAL RULING.

 returned to the state Court of Appeal on Friday to try to overturn a Superior Court judge's second prohibition on tearing down St. Vibiana's Cathedral.

In a request to have the court overturn the ruling of Superior Court Judge Robert O'Brien, attorney John McNicholas argued that the archdiocese should be allowed to demolish the 120-year-old building since the City Council removed it as a historic-cultural monument.

McNicholas also argued again that the archdiocese should not be required to conduct an environmental study on St. Vibiana's because it violates the church's right of free expression.

The archdiocese has a similar matter pending before the Court of Appeal on O'Brien's initial ruling that blocked the demolition.

Because of the court actions and what he said he anticipates will be further legal challenges, Mahony said he is abandoning the site and looking elsewhere in the downtown area for his project.

The state Court of Appeal received the final arguments on the first case Tuesday, but has yet to issue a ruling.
