 CHOCOLATES A LA CARTE WINS FIRST COPYRIGHT
 INFRINGEMENT SUIT FOR PRESENTATION OF FOOD
 LOS ANGELES, Nov. 2 /PRNewswire/ -- A jury in the U.S. District Court for the Eastern District of Pennsylvania upheld the contentions of Rena Pocrass, president of Los Angeles-based Chocolates a la Carte Inc., and found that both Ira Dubner and Presidential Confections Inc., doing business as The Chocolates Studio of Norristown, Pa., willfully infringed a copyright in the appearance of a work in the form of a chocolate nautilus shell (originally designed for a luncheon honoring Nancy Reagan in 1986) created by Pocrass. The finding came after a three-day trial in Philadelphia that ended on Oct. 28, 1992.
 "According to our research, this is the first time in any court that the presentation of food has been found to be protected by a copyright," says Los Angeles copyright attorney Michael A. Painter, a partner at Cooper, Epstein & Hurewitz, who represented Chocolates a la Carte in its trial. "This judgment will prevent anyone from knowingly producing competitive products which are significantly similar to designs copyrighted by Chocolates a la Carte."
 Post trial proceedings have been scheduled for Nov. 13, 1992, in Philadelphia to determine the terms of the injunction to be imposed and the amount of damages to be awarded to Chocolates a la Carte.
 Chocolates a la Carte was established in 1986 by Pocrass. The company provides more than 2,500 hotels, meeting planners and corporate gift buyers nationwide with a selection of more than 350 designs of specialty chocolates, dessert containers and personalized gifts.
