CHARGES DROPPED IN ATTACK ALLEGATION.

 - A 61-year-old man accused of attacking a senior-citizens apartment neighbor as she slept was released from jail Wednesday after the charges against him were dismissed.

, said he doubted that prosecutors could prove the case to 12 jurors beyond a reasonable doubt.

``I reviewed the case and my assistant head deputy also reviewed it. It was a very difficult case to begin with,'' White said. ``It just appeared that we had given our best shot. There was no new evidence. There was nothing that made me believe we would be able to convince another six people.''

The defense argued that the 71-year-old woman's boyfriend was involved and that she accused Tellez to cover up what essentially was a domestic-violence incident. Tellez was accused of breaking into the woman's apartment in the senior complex in the 43300 block of Sierra Highway Sierra Highway is a road in Southern California, United States. It runs from Tunnel Station near the north limit of the City of Los Angeles, where it intersects with San Fernando Road and Foothill Boulevard, as well as Interstate 5, and continues north to Mojave, mostly paralleling  on Feb. 2, 2005, beating her and breaking bones in both her feet.

Barrera said the woman did not immediately report the attack, and told paramedics who came to her apartment the next morning that she had fallen out of bed and was having trouble walking.

The boyfriend, who was called to the witness stand by the prosecution, denied attacking the woman, Barrera said.

``Why does a person who is viciously attacked in her bedroom not immediately call authorities and say, `I've been attacked,' and then the next morning create a false story about falling out of bed?'' Barrera said Wednesday. ``In my opinion, people create false stories to cover up for somebody.''

Deputies said there was no indication of any sexual assault and nothing was stolen, so investigators did not know what prompted the attack.
