Holders of the Corporation's preferred shares had claimed that they should have been treated as creditors of the Corporation for purposes of the Corporation's Plan of Arrangement under the Companies' Creditors Arrangement Act. The Plan of Arrangement came into effect on January 1, 1993. Under the Plan of Arrangement, holders of the Corporation's preferred shares received approximately 1 million new common shares of the Corporation, which represents approximately 5 percent of the outstanding common shares. The decision of the Court is open for appeal for a period of 30 days.
