CDT Responds to Luxell Black Layer Licensing Lawsuit.

CDT signed a license agreement with Luxell in November 2001 on the basis of Luxell's representations that Luxell's Black Layer technology was compatible with CDT's LEP technology and ready to be licensed to CDT's display manufacturing licensees for commercial production development. CDT made an initial payment of $1 million under the terms of the license.

On Sept. 12, 2002, Luxell issued a statement admitting to "compatibility issues" with its Black Layer technology involving its other partner, Tohoku Pioneer of Japan. CDT has experienced similar difficulties, including inability to establish the manufacturability of LEP displays with Black Layer for mass production.

CDT has used considerable technical resources to try to replicate the application of Black Layer technology to the manufacture of LEP displays without success. CDT offered to enter into joint development to attempt to resolve the identified shortcomings A shortcoming is a character flaw.

Shortcomings may also be:

Luxell chose to terminate the license on Oct. 10, 2002, and announced its intention to pursue the matter in court.
