CARO MOM MUST PAY OWN FEES; FAMILY FUNDS IN DISPUTE.

Judge John Smiley said he wanted documents detailing the value of property owned by Cora Caro and her husband, Dr. Xavier Caro, who on Thursday filed a wrongful death The taking of the life of an individual resulting from the willful or negligent act of another person or persons.

If a person is killed because of the wrongful conduct of a person or persons, the decedent's heirs and other beneficiaries may file a wrongful death action
 suit against her in the fatal shootings of their three oldest sons.

The property question arises because Dr. Caro filed for divorce from the suspect on Dec. 8.

Cora Caro's divorce attorney, Rand Pinsky, is seeking $550,000 of the couple's joint assets to pay for her defense by prominent criminal attorney Richard Plotin. Smiley set a Jan. 5 hearing to decide the issue.

Meanwhile, Deputy District Attorney Richard Holmes hinted that triple-murder charges would be filed against Caro this morning, hours before her scheduled 1:30 p.m. arraignment.

Cora Caro was found in another room with an apparently self-inflicted gunshot wound to the head. A handgun found near her was later determined by officials to have been used in all the shootings.

The couple's youngest son, 15-month-old Gabriel, was unharmed and is living with his father.

Xavier Caro filed the wrongful death suit in an effort to freeze the couple's assets so they cannot be spent on her defense.

``We're just trying to prosecute our claim,'' said Henry Friedman, Xavier Caro's attorney. ``We believe she killed three of his children.''

The suit claims that Cora acted ``with oppression, fraud, malice'' so the plaintiff is entitled to unspecified punitive and exemplary damages exemplary damages n. often called punitive damages, these are damages requested and/or awarded in a lawsuit when the defendant's willful acts were malicious, violent, oppressive, fraudulent, wanton, or grossly reckless. .

``As a result of the intentional, reckless and/or negligent conduct of Cora . . . (Xavier) has lost the love, companionship, comfort, affection, society, solace and support of Joey, Michael and Christopher, each of whom he loved deeply,'' the suit says.

The nature of the incident was the primary grounds on which Pinsky argued his case before Smiley.

With Plotin's silent presence in the courtroom, Pinsky said the release of ``emergency funds'' was imperative to Caro's defense because she might be facing the death penalty.

The only money Caro has for a defense so far is an ``oral commitment'' of $60,000 from her parents' savings account Savings Account
