CAMINO LABORATORIES INC. TO SUE NELLCOR INC. FOR PATENT INFRINGEMENT

CAMINO LABORATORIES INC. TO SUE NELLCOR INC.
 FOR PATENT INFRINGEMENT
SAN DIEGO, Sept. 8 /PRNewswire/ -- Camino Laboratories Inc., a leading privately held manufacturer of critical-care medical devices located in San Diego, reported today that it will file a counterclaim against Nellcor Inc. (NASDAQ: NELL), a Hayward, Calif.-based manufacturer of pulse oximetry systems. Camino Laboratories will seek damages for infringement and an injunction prohibiting further infringement by Nellcor of a Camino Laboratories patent covering a transducer calibration system.
Camino Laboratories reported that, although the parties had been in discussion, Nellcor initiated court proceedings by filing suit. Suit was filed in the U.S. District Court in San Francisco on Aug. 26 seeking a court order declaring the Camino Laboratories patent invalid and not infringed.
Robert Anderson, chairman of the board of Camino Laboratories, said, "We have been in discussion with Nellcor over the matter of infringement since mid-1991. Unfortunately, we have not been able to reach an agreement and Nellcor has now turned to the courts.
"Our patent was originally granted by the U.S. Patent Office in 1984 and was upheld even after a re-examination by the patent office in 1990-91. We believe that virtually all of Nellcor's current product line of resistor-coded pulse oximeter sensors and systems, which are designed for determining the oxygen saturation of a patient's blood, infringes a valuable and enabling Camino patent. Camino and its investors are convinced that Camino will win a jury verdict upholding its position and awarding substantial damages against Nellcor."
Camino Laboratories is a market leader in neurosurgical products, producing more than half the intracranial pressure monitoring devices used worldwide.
