CALIFORNIA COMPANY BARRED FROM MISUSE OF XEROX NAME

STAMFORD, Conn., Nov. 2 /PRNewswire/ -- A federal court has ordered a California company to stop using the "Xerox" trademark on its products and to stop using packaging that imitates packaging used by Xerox Corporation.
The permanent injunction, issued Oct. 27 by the United States District Court for the Central District of California (Los Angeles), results from a suit filed by Xerox against Graphic Technologies Corporation of Newbury Park, Calif., and the company's president, Ira J. Seaver. The company sells toner and other copier and printer supplies.
Graphic Technologies is also required by the order to send customers a letter explaining the court order and acknowledging that it had improperly used the Xerox trademark on its products. The letter also asks customers to return to Graphic Technologies any products bearing the Xerox trademark purchased from Graphic Technologies.
Xerox filed the suit June 14, claiming that Graphic Technologies had infringed upon Xerox trademarks by selling products and using cartons bearing the Xerox name and other markings imitating those used by Xerox on packaging for its toner and other products.
The order permits Graphic Technologies to state that its products are usable with Xerox equipment so long as the Graphic Technologies products and packaging are also clearly labeled with a notice that the products are not manufactured by Xerox, do not meet Xerox design specifications and are not warranted or approved by Xerox.
