Burnsville Residents File Lawsuit Against City of Burnsville.

BURNSVILLE, Minn. -- After more than twenty years TWENTY YEARS. The lapse of twenty years raises a presumption of certain facts, and after such a time, the party against whom the presumption has been raised, will be required to prove a negative to establish his rights.

Burnsville consists of three school districts, and residents living in ISDs 194 and 196 attendance areas aren't receiving their fair access to Burnsville-owned facilities. And in spite of repeated attempts over the years to work with the city council to modernize the allocation policy guidelines, these residents are still being short changed. The city says they have confirmed their policy and will not re-visit the issue.

The policy was created more than 20 years ago, when the Burnsville population was just 24,000, and favors user groups living in ISD 191 because the city says they have a strong historical connection, a long affiliation and contribute to the success of the facility - whether or not members of the user groups are residents. Today's 60,000-resident city is still subject to a decision-making policy based A decision made by any software application that is based on the policy (rules and regulations) of the organization. "The city has been very difficult to work with and very reluctant to change a discriminatory policy," said Kent Keckeisen, Burnsville resident and volunteer president of the Apple Valley Hockey Association (AVHA), a long-term user group. "City council members have refused to allow Burnsville residents who are AVHA members to speak or be on the agenda at city council meetings. A city council member even instructed city staff not to put any more effort into researching a solution."

 usage model that is based on the idea that all residents and resident user groups should receive proportionally equal opportunity of time allocation of city-owned facilities.

"We feel it is very unfortunate that as citizens we have to take this action against our city on behalf of our children," said Dan Hanlon, a Burnsville resident and volunteer board member of the AVHA. "We feel this is a solvable issue that other communities have resolved."

In contrast to the Burnsville policy, the cities that border Burnsville, which also have the same issue of multiple school districts, have objective policies that are fair to residents. The city of Apple Valley allocates facility use based on the number of Apple Valley residents that belong to each respective resident user groups, and not based on total membership. The city of Eagan, also uses an allocation guideline that includes its resident user groups.

"Given the inability of my clients to resolve this matter through other means, the court action was the only remaining procedure to insure Burnsville residents are provided fair, proportional and reasonable access to the city owned facilities," said Mark Schneider, the lawyer for the residents of ISD 196 and members of the AVHA.
