Building up to code: insurers back stronger building codes to lessen catastrophe losses, but progress is slow in two Gulf States.Stronger building codes have made a big difference in hurricane losses in Florida, and efforts are being made to bring some of that success to Louisiana and Mississippi in the wake of hurricanes Katrina and Rita. But start-up problems plague the process in Louisiana, and Mississippi's new code applies only to a few coastal areas and is optional. "It's a start," said Tim Reinhold, vice president of engineering for the Institute for Business and Home Safety. "That's just a start down the path they need to go." Most of Louisiana's parishes did not have any building code prior to the new statewide code, which was signed into law in December 2005 and still has a year to be fully implemented. Several coastal parishes have had the code implemented through an emergency provision. Meanwhile, Mississippi, which also lacked building codes in most of the state, has created a commission charged with developing a voluntary statewide code. Emergency provisions for a few of the coastal counties were enacted, but those counties can opt out. "We would like to see all of the coastal counties require new buildings be built to be resistant to floods and resistant to hurricanes" said Keith Lessner, vice president of loss control for the Property Casualty Insurers Association of America. Insurers favor stronger building codes in hurricane-prone areas because they reduce losses. "Building codes are a critical part of a larger loss mitigation effort," said Greg Heidrich, senior vice president of policy development and research at PCI. Heidrich said Florida's adoption of a statewide building code in 1995 had a "dramatic effect on loss prevention." "When we looked at the damage from Hurricane Charley, we were really able to see the difference" agreed Reinhold. Houses that would have been blown apart under the old code were still standing, he said. Studies showed a large reduction in the number of claims filed for homes built under Florida's statewide code. According to Reinhold, homes built after the post-Hurricane Andrew codes in Florida had 30% fewer losses than homes built in the 1980s and 1970s.And only 10% to 20% of homes built under the statewide Florida code had filed claims, compared with about 50% of homes built before the post-Andrew codes. "It's incredible the difference between how a new home fared, compared to an older home right next to it," said Sam Miller, executive vice president of the Florida Insurance Council. "The building code made a dramatic difference?" Key Points * Stronger building codes have successfully reduced losses from hurricanes in Florida. * Implementation of new building codes in Louisiana and Mississippi has many hurdles to cross. * While builders have concerns with added costs, insurers believe consumers will pay for the added safety. Start-Up Problems But in both Louisiana and Mississippi, the new codes face challenges in implementation, said Reinhold. "They've got to get their builders up to speed and that takes time," Reinhold said. "It's going to take time. They have a way to go. It's going to be a lot of training for people?" Randy Noel, chairman of the Louisiana Code Council, said the lack of code officials and inspectors in the state who understand the new code has presented many problems. "The immediate problem is no one had a clue what was in those standards," Noel said. "The problem is, it's not something you learn quick. The home builders don't know what to build and the code officials don't know what to inspect. It's slowing down the rebuilding process?" Reinhold said in the first few months after the code became effective, no building permits were issued because code officials and building inspectors did not understand the new rules. Noel said issuance of permits is still "very slow." The "huge slowdown" in construction is a big issue in a state trying to rebuild from Hurricane Katrina. Noel said prior to the hurricane, 15,000 to 18,000 homes a year were being built. That number has risen to 20,000 new homes a year to be built, with another 200,000 homes in the state that still need repairing. Since the Louisiana code's implementation, the number of building inspectors has increased from 35 to 120, Noel said, but he said there's still not enough manpower to handle the load. This is complicated, he said, by the expense municipalities will face in order to open code offices, which will likely cause permit prices to soar. But a potential solution is regional planning commissions forming code offices, something Noel said there is movement on. On the Fast Track Under legislation signed in December 2005, the 11 Louisiana parishes hardest hit by Katrina had 30 days to implement the new building code if they already had building inspectors. Otherwise, they had 90 days. The parishes are shown below. Mississippi has created a commission charged with developing a voluntary statewide building code. Emergency provisions were enacted for the coastal counties shown below, but those counties can opt out. Noel said another problem for builders in Louisiana is that the new code is so complex. He said, under the code, builders have to design every house from scratch, which is "problematic" "There's not a simple list of things to do," he said. "It has to be so much simpler." Reinhold said the Institute for Business and Home Safety is working on ways to help Louisiana builders build while they learn the new code and it is developing a simplified checklist of the new requirements for builders to follow. However, this doesn't help builders' other concern of cost. Noel said the rising cost of permits, coupled with the added materials and other costs, is going to cause a spike in cost for builders of about 15% to 20%. This is on top of a 15% rise in costs related to Katrina. He believes this will cause housing prices to go up at least 8% in the long term. Reinhold said the cost increase is moderate and the new codes will "make a huge difference" in losses from storms. Noel said that will help insurers, but builders worry how the increased costs will affect them down the road. "We're working through what we have to work through. If it costs more, we'll just pass it along to the customer," Noel said. "It'll hurt us in the long run" "The building code discussion reminds me a little bit of the air bag discussion 15 years ago," Heidrich said. "The automakers weren't sure Americans would pay for safety." Now air bags are integral to auto advertising campaigns, he noted. STANDING UP TO STRESS: Hardware straps provide the continuous load path from the double top plate, across and down the framing members on a garage return wall. Updates in Florida Back in Florida, Reinhold said structurally the statewide codes were a step forward, but water intrusion was still a factor during the 2004 and 2005 hurricanes. He said the code is being updated to include roof covers and other water issues, which could help reduce claims by 30%. He also said Florida builders "are being pretty receptive" to fine tuning the code. The Florida Home Builders Association "believes it's important to note the evolution of the code must continue to look at the latest technology, while also giving due consideration to the cost of change," said Edie Ousley, public affairs director for the FHBA FHBA - Florida Home Builders Association. Ousley said the FHBA "long-supported a single statewide code because it provides for more consistent construction when moving from jurisdiction to jurisdiction. A uniform code also provides for better understanding of requirements and better education and training on the code." Florida's code, Ousley said, "has proven itself." "With two back-to-back record-breaking seasons of damaging hurricanes, the code has performed exactly as it was designed to do" Ousley said. "In the last two years, we've seen the proof. Newer-built homes have withstood the storms, and damage has been minimal. New testing of construction techniques and products, as well as new hurricane-resistant products, continue to make the code better" Meanwhile, Florida Gov. Jeb Bush signed a bill into law earlier this year that provides $250 million in funding for a hurricane mitigation program. Under the program, homeowners can apply for dollar-for-dollar matching grants of up to $5,000 to help pay to retrofit their home for hurricane resistance. The program also provides free hurricane-proofing inspections. Heidrich said PCI supports incentive programs to retrofit older homes and said insurers generally take mitigation efforts into account in their market actions. And, he said, stronger building codes are needed in all catastrophe-prone states, not just the Gulf region, though not always statewide. The issue is one of the key items PCI is focusing on and the trade association will push for more code improvements in 2007, Heidrich said One of the other issues that goes hand-in-hand with stronger building codes is land use laws. Homes are being built in areas where there were no homes before, many are moving to the coast and homes are increasingly exposed to risk, Heidrich said. States need to ask if people should be allowed to build in certain risky areas, he said. Land use restrictions, Heidrich said, are a natural fit with stronger building codes.
