The district court granted summary judgment in favor of the officials and the inmate appealed. The appeals court affirmed in part, reversed in part, and remanded. The appeals court held that fact issues as to whether the officials abused the prison gang validation procedure as a cover or ruse Ruse (r`sĕ), city (1993 pop. 170,209), NE Bulgaria, on the Danube River bordering Romania. The chief river port of Bulgaria, it is also an industrial and communications center.  to silence and punish the inmate, barred summary judgment on his First Amendment retaliation claim.
