Boston Scientific stent infringes Medinol patent.


On June 24, 2003 the District Court in Dusseldorf (Patent Chamber) Germany, decided in favor of Medinol (Tel Aviv Tel Aviv (tĕl əvēv`), city (1994 pop. 355,200), W central Israel, on the Mediterranean Sea. Oficially named Tel Aviv–Jaffa, it is Israel's commercial, financial, communications, and cultural center and the core of its largest , Israel) regarding Medinol's infringement law suits against Boston Scientific The Boston Scientific Corporation (NYSE: BSX) (abbreviated BSC), is a worldwide developer, manufacturer and marketer of medical devices whose products are used in a range of interventional medical specialties, including interventional cardiology, peripheral interventions,  and its director, Mr. Michel Darnaud. Following these decisions, Boston Scientific's "Express" stent stent (stent)
1. a device or mold of a suitable material, used to hold a skin graft in place.

2. a slender rodlike or threadlike device used to provide support for tubular structures that are being anastomosed, or
 is infringing Medinol's patent EP 762 856 and utility model 295 21 206.

The court has examined the Express stent, which Boston Scientific has announced to be in use also in its "Express2" and "Taxus" stents, and found it to be making use of the protected technology of Medinol.

Accordingly, Boston Scientific will have to pull all the Express stents from the German market even if Boston Scientific exercises its right to appeal the decision because Medinol intends to secure a deposit to enforce its patent and utility model rights. In addition, the court decided that Medinol is entitled to damages from Boston Scientific. For the purpose of determining the amount of damages, the court ordered Boston Scientific to open its books and records to Medinol. The amount of damages to which Medinol is entitled to receive from Boston Scientific will be determined at a later date. Boston Scientific can appeal this judgment also insofar in·so·far

To such an extent.

The injunction granted by the court against Boston Scientific can be enforced as soon as the decision has been served to Boston Scientific.
