Richard Wagstaff "Dick" Clark (born November 30, 1929) is an Emmy Award-winning American television, radio personality, game show host and businessman, he served as
Productions Inc., claiming he was cut out of payments due on his work on "TV's Bloopers and Practical Jokes."

In a suit filed May 20 in L.A. Superior Court, Smith claims he had not received payments for his work on the show, now in its 23rd year, since its debut year despite a contract calling for ongoing payments.

Under a 1980 agreement, Smith helped produce, schedule, budget and select the cast for "TV's Censored Bloopers," now "TV's Bloopers and Practical Jokes," the suit says. He was to receive a fee of $25,000 for each program in the first year, as well as 8.33 percent of net profits "derived from production, distribution and exploitation of any and all programs produced," the suit says.

After seven episodes, Smith did not receive any payments and "assumed Dick Clark Productions was no longer producing, distributing and exploiting the programs," the suit says.

He sued for breach of contract, breach of fiduciary duty Noun 1. fiduciary duty - the legal duty of a fiduciary to act in the best interests of the beneficiary

, declaratory relief declaratory relief n. a judge's determination (called a "declaratory judgment") of the parties' rights under a contract or a statute often requested (prayed) for information in a lawsuit over a contract.  and an accounting to determine how much he is owed, the suit says.

Smith's lawyer, Stanton "Larry" Stein, a partner at Alschuler Grossman Stein & Kahan LLP LLP - Lower Layer Protocol , declined comment, as did Paul Shefrin, a spokesman for Dick Clark Productions.

Dick Clark Productions was acquired in July 2002 by a group led by Mosaic Media Group Inc. and CDP CDP (cytidine diphosphate): see cytosine.
