:BVF) today announced that the Ontario Securities Commission The Ontario Securities Commission (OSC) is a regulatory agency which administers and enforces securities legislation in the Canadian province of Ontario. The OSC is an Ontario Crown corporation which reports to the Ontario legislature through the Minister of Finance.  (OSC O.S.C. n. short for Order to Show Cause. (See: Order to Show Cause) ) has advised that, in addition to the matters most recently disclosed in the Company's second quarter financial statements, the OSC is investigating the Company's revenue recognition for accounting purposes for each of the four quarters of 2002 and 2001, and related disclosure issues.

Biovail has co-operated fully, and will continue to co-operate fully, with the OSC in these matters.

The Company cannot predict the outcome or timing of when these matters may be resolved. Biovail is not in a position to comment further on these matters at this time.
