:BVF) announced that Biovail Laboratories, Inc. ("Biovail") and Teva Pharmaceuticals Curacao N.V. ("Teva") entered into an Exclusive Distribution Agreement through which Teva became the exclusive distributor of a number of Biovail products.

Pursuant to the audit provisions of that Agreement, Biovail retained Deloitte & Touche to investigate the propriety of certain deductions made by Teva in arriving at the Products' Net Sales Net Sales

The amount a seller receives from the buyer after costs associated with the sale are deducted.

Notes:
This amount is calculated by subtracting the following items from gross sales: merchandise returned for credit, allowances for damaged or missing goods, freight
 on which Biovail and Teva were to share profit.

As a result of the audit investigations, Biovail has commenced Arbitration proceedings against Teva to recover Biovail's proportion of approximately $98 million of what Biovail is alleging were improper deductions by Teva.

Biovail has also alleged that Teva's conduct with respect to its activities ought to allow for additional damages and punitive damages Monetary compensation awarded to an injured party that goes beyond that which is necessary to compensate the individual for losses and that is intended to punish the wrongdoer.  in amounts to be determined at trial.

Furthermore, Biovail has alleged that Teva's breaches ought to result in declaration that the Agreement is terminated without a right by Teva to cure such breach.
