The injunction will take effect on August 22, 2005. This ruling was made after the Court found that Medtronic's redesigned polyaxial screws infringe U.S. Patent No. 5,474,555 (the "'555 patent"), which is owned by Cross Medical Products, Inc. ("Cross"), a Biomet company. Previously, the Court entered a permanent injunction against Medtronic's original versions of its MAS, Vertex, M8, M10, Sextant, Legacy 4.5, and Legacy 5.5 polyaxial screws.

In other rulings this week, the Court, in reversing its previous order, found in favor of Cross that several claims in Cross' patent related to crosslinks used with spinal implants are not invalid. The Court already found that certain of Medtronic's crosslinks infringe Cross' patent. The Court also refused to reconsider its prior decision that Medtronic's redesigned polyaxial screws infringe the '555 patent.
