BioCell Technology, LLC, exclusive worldwide supplier of BioCell Collagen II(R), has filed suit against Cyvex Nutrition, Inc. this week for alleged infringement of several of its key patents. BioCell Technology has pioneered a novel dietary supplement derived from sternum cartilage known as BioCell Collagen II(R).

According to the suit, for an extended period of time, Cyvex Nutrition has offered for sale, sold, and continues to make, use and offer for sale Chicken Collagen Type II material containing Chondroitin Sulfate and Hyaluronic Acid that infringes on BioCell Technology's patents. Despite Cyvex Nutrition's alleged knowledge of these patents, it has neither requested nor received any authorization from BioCell Technology to manufacture, make, use, sell or offer to sell the patented invention, but has continued to infringe the patents in willful defiance and disregard of BioCell Technology's patent rights.
