) today announced that the District Court in Tel-Aviv yesterday dismissed the appeal filed by Biogen, Inc., of a decision by the Israeli Commissioner of Patents which granted BTG's Israeli subsidiary a compulsory license In a compulsory license, a government forces the holder of a patent, copyright, or other exclusive right to grant use to the state or others. Usually, the holder does receive some royalties, either set by law or determined through some form of arbitration.  under Biogen's hepatitis-B vaccine patent. The court affirmed the grant of the compulsory license to BTG's Israeli subsidiary. While this decision may be appealed to the Israeli Supreme Court, the license is effective and allows the Company to register and commercialize its third generation hepatitis-B vaccine in Israel and to export it to countries in which Biogen does not have a corresponding patent.
