Acxiom Corp. of Little Rock has been sued by former shareholders of Total eData Corp., a Nevada corporation A Nevada Corporation is a corporation chartered under the laws of the U.S. state of Nevada.

Nevada, like the state of Delaware (See Delaware corporation), is well known as a corporate haven.
, for improperly billing $150,000.

In a suit filed July 11 in Pulaski County Pulaski County is the name of several counties in the United States:

 Circuit Court, Joseph Blankenship, trustee for the ex-shareholders, claimed Acxiom billed the company for services never performed.

But the lawsuit also reveals details of Acxiom's e-mail marketing Email marketing is a form of direct marketing which uses electronic mail as a means of communicating commercial or fundraising messages to an audience. In its broadest sense, every email sent to a potential or current customer could be considered email marketing.  campaign involving millions of e-mail addresses--which sounds a lot like that infamous and noxious noxious adj. harmful to health, often referring to nuisances.  "spam," except these people apparently want it.

The suit stemmed from a business relationship dating back to November 2000 in which Total eData matched e-mail addresses with people's names and physical addresses to develop marketing databases for Acxiom, according to according to

 the lawsuit. Targeted were people who had agreed to receive such marketing, and Acxiom would use the data for e-mail prospecting by its clients.

Acxiom paid $450,000 up front to Total eData and $25,000 per month for data updates--but never less than 5 cents per name--according to court filings. Also, Acxiom paid 50 percent of gross revenue earned from data to Total eData--at least 6 cents per name for e-mail prospecting and 20 cents per name for e-mail appends.

Court filings also revealed a data licensing agreement amendment from August 20, 2001. It required Total eData to provide Acxiom a separate data file of 20 million to 25 million records for an "opportunity" from NetCreations Inc. of New York New York, state, United States
New York, Middle Atlantic state of the United States. It is bordered by Vermont, Massachusetts, Connecticut, and the Atlantic Ocean (E), New Jersey and Pennsylvania (S), Lakes Erie and Ontario and the Canadian province of
, an e-mail marketing firm, to match e-mail addresses with Total eData's data files.
