Bill C-38.


If Bill C-38 is passed, we will not accept it as a valid law. In fact, to refuse to accept C-38 as a valid law is the duty of all Canadians.

The preamble to the Canadian Charter of Rights and Freedoms There was also precedent for religious references in Canadian politics in the national motto ("A Mari usque ad Mare"), which is derived from Psalm 72. The reference to the supremacy of God was new to the Canadian Constitution itself, however.  states: "Whereas Canada is founded upon principles that recognize the supremacy of God and the rule of law." Thus, the Charter, as Professor Farrow says, "explicitly link[s] belief in the rule of law to belief in the sovereignty of God." Thus, Canadian legal tradition is based on the classical view that a civil law is valid only if, inter alia [Latin, Among other things.] A phrase used in Pleading to designate that a particular statute set out therein is only a part of the statute that is relevant to the facts of the lawsuit and not the entire statute. , it is compatible with the natural moral law and does not "exceed the proper authority of the body that enacts it."

The natural law is God's eternal law as it is "built into the design of human nature and woven into the fabric of the normal human mind" (J. Budziszewski, What We Can't Not Know). As such, it forms, as it were, part of who man is, and its fundamental precepts and "their first ring of implications" are the "universal common sense of the human race"; they can't not be known. Thus, whenever a state legislates a law that contradicts the natural law, it has no authority in so doing and performs an act of illicit legislation. No one is obligated ob·li·gate

 to accept that legislation; in fact, everyone is obligated to refuse to accept it.

The Vatican has said Bill C-38 and similar legislation in Spain are characterized as being "violent attacks against the family." Pope Benedict says, "The various forms of the dissolution of matrimony MATRIMONY. See Marriage.  today, like free unions, trial marriages, and going up to pseudo-matrimonies by people of the same sex, are rather expressions of an anarchic freedom that wrongly passes for true freedom of man."
