The following was announced today by the law firm of Bernstein Litowitz Berger & Grossmann LLP LLP - Lower Layer Protocol :

Lawyers representing Rezulin users have filed the first nationwide class action law suit against Warner-Lambert Company charging that the Company used false and deceptive advertising and influence-peddling to insure that Rezulin, a pill that lowers blood glucose levels blood glucose level,

. Since its approval, use of Rezulin has been linked to serious health and safety concerns, severe liver damage and death. On March 21, 2000, at the request of the FDA, Warner-Lambert withdrew the drug from the U.S. market.

The Class Action Complaint was filed in State Court in New Jersey, by the firms of Bernstein Litowitz Berger & Grossmann LLP, Sheller, Ludwig & Badey, P.C., Williams, Cuker & Berezofsky, Eichen & Cahn, P.C. and The Consumer Advocacy Center, P.C. Warner-Lambert's headquarters are located in New Jersey.

The Complaint was filed on behalf of all individuals who took Rezulin from March 1, 1997 through March 22, 2000. According to according to

 allegations listed in the Complaint, Warner-Lambert knowingly concealed material facts about the safety and efficacy of Rezulin from the FDA. It is further alleged that the Company engaged in deceptive and misleading practices, including withholding information from consumers and physicians about the adverse event reports confirming severe liver damage and the numerous deaths associated with the drug.
