The officer appealed. The appeals court affirmed. The appeals court held that the district court did not abuse its discretion by granting a new trial on damages. The officer had searched the prisoner's cell while the prisoner was in the prison yard for his daily hour of "yard time." When the prisoner returned to his cell he found it in disarray and he noticed that some of his legal papers and medical snacks had been taken.
